In
these rules, any reference to a gender shall include the other
gender.

For
purposes of these rules, all time periods shall be determined
in accordance with Pacific Time (GMT-8).

Entry
Requirements and Restrictions
-
The
competition may only be entered online at the website: www.frisc.com
-
All
fields in the entry form must be completed to be considered a
valid entry.
-
There
is no restriction as to the number of answer entries per participant.
-
An
entry which is incomplete, illegible and/or corrupted shall not
be considered a valid entry and shall be disqualified.
-
Competition
form entries by automated systems or software will be disqualified.
-
By
submitting an entry, the participant declares that there are no
legal restrictions in his
country of residence which prohibits his participation
in this competition.
-
No
entries will be accepted after the target of 100 000 members is
reached and the competition closes.
-
Employees
of the organiser or of its advertising and promotion agencies
and their immediate families shall not be eligible to participate
in the competition.
-
Duration
of competition
The competition will
open on 28 February 2001 and close once the target of
100 000 members is reached (hereinafter referred to as the "closing
date").

Competition
Format
-
A
participant is required to answer the following question:WHAT
IS A FRISC ?
-
A
participant is required, at the time of entering the competition,
to indicate which 1(one) of the 3(three) advertised prizes he
chooses should his answer be selected as the winning answer and
he be declared the winner of the competition.
-
The
winner of the competition will be determined by the organiser
as soon as reasonably possible after the closing date.
-
The
winner will be the entrant who the organiser determines has
provided the closest correct answer to the questions
referred to in 4.1 above.
-
The
decision of the organiser as to who the winner is shall be final
and binding on all participants. No correspondence shall be entered
into with any participant and nor shall the organiser's decision
be subject to any appeal or review.
-
Prize
Allocation
-
The
winner shall only win 1(one) prize, namely the prize which he
chose when he entered the winning answer.
-
The
prize shall be non-transferable, non-negotiable and shall
not be redeemable for cash. No prize substitution shall
be permitted.
-
The
exact configuration and specifications of the selected prize may
vary slightly depending on the manufacturer and/or the supplier
thereof ,and/or geographical location of winner.
-
The
delivery of the prize to the winner will depend on the type of
prize and will be as follows:
-
Airline
tickets:
-
The
airline tickets comprise 2(two) economy class return air
tickets from (and returning to) a point of departure to
be chosen by the winner.
-
The
winner has the option to choose the airline on which he
wishes to fly, subject to the organisers approval.
-
The
winner shall be responsible for his cost of travelling
to and from the point of departure referred to in 5.4.1.1
above.
-
The
tickets shall be subject to the terms and conditions of
the relevant airline, including but not limited to the
available time of travel.
-
Save
for the cost of the airline tickets,
the winner shall be solely liable for all other associated
costs, including but not limited to, accommodation, insurance,
etc.
-
Airline
tickets will be issued and delivered to the winner at
the offices of the relevant
airline or its agent nearest to the winner's place of
residence.
-
Compaq
computers
The desktop and notebook computers
with accessories will be couriered to the winner's place of
residence or the nearest delivery point.
-
Digital
Camera Combination (Canon XM1/GL1 Olympus E-1)
The Canon digital video camera, and Olympus digital still
SLR camera will, at the organiser's cost, be couriered to
the winner's place of residence, or the nearest delivery point.
-
All
taxes, levies and other similar charges imposed by any governmental
authority (including but not limited to income taxes), as well
as any incidental expenses associated with the collection or use
of a prize, shall be the sole responsibility of the winner.
-
Notification
of winner
-
The
winner's name will be displayed on the frisc.com website when
it is launched after the closing date. The winner will be notified
via his/her supplied e-mail address.
-
The
winner is obliged to reply to the organiser, within 7(seven) days
of the date on which he is notified via email that he is the winner
and that he accepts his selection as the winner.Should the selected
winner not do so timeously or should the organiser discover that
the winner furnished incorrect information when entering the competition,
the organiser reserves the right to disqualify the winner and
select a new winner.

The
winner agrees to execute an affidavit of eligibility, release
of liability and/or any other documentation which the organiser
may request prior to receiving his/her prize.
-
The
winner agrees to allow the organiser (including its advertisers
and sponsors) to use his name, voice, photograph and/or likeness
in any medium of communication, including but not limited to print,
internet, radio and/or television, for advertising, promotional
or other purposes, without compensation.
-
weekly
prize
-
On
a weekly basis, for the duration of the competition, the participant
who refers the most referrals (that is, persons who register on
the organiser's frisc.com website) will receive $20 worth of Amazon.com
vouchers.
-
The
name of the winner of the weekly prize will appear the following
week on the website.
-
If
no referrals are made on any particular week, no prize will be
allocated.
-
Multiple
identities (that is, the same person referring various alias e-mail
addresses) shall not be allowed and shall disqualify the participant
from the competition.
-
There
will only be one winner of the weekly prize.
-
Should
there be more than one participant with the same number of referrals
for any particular week, the $20 worth of Amazon.com vouchers will
be awarded to the first person who attained that number of referrals.
-
The
usual terms and conditions applicable to Amazon.com vouchers shall
apply to the use thereof by the winner.
-
The
decision of the organiser as to who the weekly winner is shall
be final and binding on all participants. No correspondence shall
be entered into with any participant and nor shall the organiser's
decision be subject to any appeal or review.

Disclaimer
and indemnity
-
Participants
in this competition assume all liability, and indemnify and hold
the organiser (including its members, officers, servants, agents,
contractors, consultants, advertisers and sponsors) harmless for
any death, injury, loss of or damage to property and/or any other
damages and expenses whatsoever relating to or arising from their
participation in this competition, and/or relating to or arising
from the award of, receipt of or the use of the prize.

Without
derogating from the generality of the aforegoing, the organiser
(including its officers, servants, agents, contractors, consultants,
advertisers and sponsors) shall not be liable for:
-
any
injury or damage caused to participants or any other persons
relating to or arising from entering or downloading materials
or software from the frisc.com website and nor shall they
be liable for any technical, hardware, software or telephone
malfunctions of any kind, lost or unavailable network connections,
or failed incorrect, incomplete, inaccurate or delayed electronic
communications caused by the participant or by any of the
equipment or programming associated with or used in this competition
or by human error, which may occur in entering or processing
the entries in this competition;

telecommunications,
network, electronic, technical or computer failures of any
kind, for inaccurate transcription of entry information or
for entries which are stolen, misdirected, delayed, lost,
late or damaged.

Termination
of competition
If
for any reason whatsoever, in the sole and absolute discretion of
the organiser, the competition is not capable of running as planned,
including but not limited due to computer virus, tampering, technical
failure or fraud, the organiser reserves the right, in its sole and
absolute discretion, to terminate, alter, or suspend the competition
or any portion thereof (including the weekly competition referred to
in 7 above).
- Governing
law
-
These
rules shall be governed by and enforced in accordance with the laws
of the Republic of South Africa.
-
All
participants consent to and subject themselves to the jurisdiction
of the High Court of the Republic of South Africa.
-
Organiser's
decision final
Participants
agree that the organiser's decision on any and all matters relating
to the competition shall be final and binding and shall not be subject
to review or appeal by any judicial body or other person whatsoever.
